This week, she spoke about her joy at having her two children back in the US with her, but her custody battle with her ex-husband is far from over, it would seem.

 

Former Gossip Girl star and mother-of-two, Kelly Rutherford, found herself back in court yesterday as she presented her plea for why her children should remain in her care. While eight-year-old Hermes and six-year-old Helena are currently in New York with the 46-year-old, this is only a temporary arrangement while their father, Daniel Giersch, sorts out a new US visa.

 

Kelly has previously spoken candidly about her struggle, even breaking down into tears on live television, and she shared an emotional post to Instagram ahead of her court appearance on Friday.

 

Posting a photo of herself walking down the halls of the court, being supported by her good friend Anthony Giovanni Deane, Kelly wrote: “The Long Slow Road To Justice LA Court. Thank you and I love you.”

Kelly reportedly broke into tears a number of times during her testimony, recounting how she struggled to make it to France to visit her children as her finances dwindled. While the court previously granted joint custody to Kelly and Giersch, his lack of a valid US visa meant that Kelly has been forced to travel to his foreign home to visit their children.

 

“I’d love to be working and have my kids and have a normal life. But I’ve been forced to travel to a foreign country and spend less time in California,” Kelly reportedly told the court.
