The battle between Sofia Vergara and ex-fiancé Nick Loeb, over frozen embryos they created together, has just taken a bizarre and dramatic twist.

 

According to a report by the New York Post, the Modern Family actress is now being sued by her fertilised eggs.

 

The embryos, who have been named ‘Emma’ and ‘Isabella’, have been listed as plaintiffs in a right-to-live lawsuit.

 

 

Loeb and the embryos’ ‘trustee’, James Carbonnet, are also listed as plaintiffs in the case, which has been filed in Louisiana.

 

The crux of the latest court action is as follows: by not being born, Emma and Isabella are being deprived of an inheritance trust set up for them – by Loeb – in Louisiana.

 

The suit also claims that a contract signed by Vergara and Loeb back in 2013, at a fertility clinic, should be voided. The basis for voiding comes down to the fact that no clause dealt with what would happen to the embryos if the couple split.

 

 

The plaintiffs are now seeking for Vergara to give the embryos over to Loeb.

 

Loeb’s latest move comes just a week after he dropped another lawsuit, appealing a California court’s decision which found in Vergara’s favour.

 

 

Vergara, who is mum to 24-year-old son Manolo, wants to keep the embryos frozen ‘indefinitely’.

 

Vergara and Loeb broke off their engagement back in 2014. She went on to marry True Blood actor Joe Mangeniello, last Christmas.
