History was made recently after Kyle Casson became the first single man to have a child through a surrogate in the UK. 

 

However, this isn’t the only reason Kyle’s story has hit headlines - his eight-month-old son, Miles was born when Kyle’s mum acted as a surrogate. 

 

When a previously organised surrogate fell through due to medical reasons, Anne-Marie Casson stepped in for her son and became pregnant with Miles, using a donor egg fertilised by Kyle’s sperm. 

 

A judgement in the High Court has now ruled that Kyle can legally adopt Miles as his son with Anne-Marie telling The Daily Mail: “He is not biologically tied to me, other than he’s my grandson. I love being a parent and for Kyle to experience that, I would do that for him.”

 

Under current law in the UK, a surrogate mother must hand over a child to a couple in an enduring, loving relationship and anything other than this is considered a crime. However, due to Kyle and his son, Miles’  legal relationship as brothers, the judge ruled that the adoption could proceed. 

 

Mrs Justice Theis spoke of the surrogacy surrounding Kyle, Anne-Marie and little Miles when she said: "The arrangement the parties entered into is not one, as far as I am aware, that either this court or the clinic has previously encountered and although highly unusual, is entirely lawful under the relevant statutory provisions."

 

Judge Theis also added that the provisions reached by Kyle in order to become a parent were important: "The papers show that for some considerable time he has wanted to be a father. He waited until his circumstances were settled in terms of a job and home to enable him to provide the care a child would need.”

 

Kyle says that he understand that some people may not agree with their family set-up, but that love and support are what matter when it comes to being a parent: “I understand that not everyone will agree with it, but they can have their opinions. I have a son and am very happy. As long as people can provide a home, and they have the support, I don’t see why anyone should be denied the right to be a parent.”
